As a Sellers Agent, The Seller is the "client" in
an agency relationship to whom the salesperson owes
fiduciary duties and undivided loyalty. East Coast
Realty, Inc. will cooperate and split commissions
with selling Agents from any other brokerage company
that accepts subagency. East Coast Realty, Inc. on the Outer Banks will
also cooperate with buyer's Agents and will split
commissions at a rate equal to the split with subagents,
as long as the buyer’s Agent is not receiving compensation
from the buyer through the Exclusive Buyer’s Agency
agreement.
As a Buyers Agent, East Coast Realty,
Inc. on the Outer Banks will represent the buyer exclusively and will
seek compensation first out of the transaction
according to terms agreed to in the buyer agency
agreement. Only if compensation is not available
out of the transaction in whole or in part will East
Coast Realty, Inc. look to the buyer for payment
of the unpaid portion.
When representing a buyer
or a seller, East Coast Realty, Inc. Agents will
disclose to them that the company policy is one
of disclosed dual agency should a buyer client decide
to purchase a seller client's property.
In the
event of dual agency, East Coast Realty, Inc. and
its Agents will not disclose to the buyer the lowest
price that the seller will take, nor disclose to
the seller the highest price that the buyer will
pay. Should there be other terms that either party
considers as strictly confidential, specifics regarding
these terms can be included in a dual agency consent
agreement and thereby held as secret from the other
client. Likewise, should there be normally confidential
terms that either party is willing to make known,
specifics regarding these terms can be included
in a dual agency consent agreement and thereby be
made known to the other client.
